Terms of Service

These Terms of Service (“Terms”) govern your use of KitchenPro (“we,” “us,” the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

You must be at least 18 and able to form a binding contract. You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us promptly at hello@kitchenpro.restaurant of any unauthorized use.

2. Subscriptions, Trials & Billing

• New customers may receive a $1 trial for the first 14 days. Your payment method is charged $1 at signup and then $24/month (or the current published rate) at the end of the trial unless you cancel.
• Paid subscriptions renew automatically at the interval shown at checkout until canceled.
• Payments are processed by Stripe. By providing payment information, you authorize us to charge the applicable fees and any taxes.
• You may cancel anytime from your billing portal. Cancellation stops future renewals; it does not entitle you to a refund of fees already paid, except where required by law.
• Prices and plans may change on 30 days’ notice.

3. Acceptable Use

You agree not to:

• Use the Service to violate any law or third-party right, including copyright on recipes, photos, or other uploaded content.
• Reverse engineer, decompile, or attempt to extract source code.
• Resell, sublicense, or share access with parties outside your organization.
• Upload malware, spam, or content that is harassing, defamatory, or illegal.
• Interfere with or disrupt the Service, servers, or networks.
• Use automated means to access the Service except through documented APIs.
• Use AI features to generate content you do not have the right to store or publish.

4. Your Data

You retain all rights to the data you upload (“Customer Data”) — including your recipes, ingredient costs, vendor information, and photos. You grant us a limited license to host, process, and display Customer Data solely as needed to provide the Service, including sending relevant content to AI providers to power features you invoke. You represent that you have the right to upload and use this data in compliance with applicable law.

5. AI Features

The Service uses third-party AI to read recipes from photos, parse invoices, match ingredients, and assist with recipe creation. AI output may contain errors — always review extracted ingredients, costs, quantities, and instructions before relying on them in a commercial kitchen. We are not liable for food cost miscalculations, allergen omissions, or other errors arising from AI-generated content.

6. Our Intellectual Property

The Service, including its software, design, and content (excluding Customer Data), is owned by KitchenPro and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.

7. Service Availability

We aim for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or changes to the Service at any time.

8. Termination

You may terminate your account anytime. We may suspend or terminate accounts that violate these Terms, fail to pay, or create risk or legal exposure. Upon termination, your right to use the Service ends. Sections that by their nature should survive termination will survive.

9. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that defects will be corrected. Food cost calculations are estimates based on the data you enter; you are responsible for verifying them before menu pricing or reporting.

10. Limitation of Liability

To the maximum extent permitted by law, KitchenPro will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless KitchenPro from claims arising out of your use of the Service, your Customer Data, or your violation of these Terms or applicable law.

12. Governing Law

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Maryland, and you consent to personal jurisdiction there.

13. Changes to These Terms

We may update these Terms. Material changes will be posted on this page with a new effective date. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
